Should the MIFID II be Aspiration or a Mere Inspiration for the EU Regulation of Insurance Distribution?
Against the background of the specific and heavily regulated area of financial services, the article focuses again on a broader topic, which is the transferability of EU harmonization within individual sub-areas and powers entrusted to the European Union. In the article, I focus on capital markets and the insurance industry, but a similar analysis could be made, for example, in the field of transport, namely the effect of regulation of air transport on railways. It seems that under the veil of consumer protection, which is one of the EU's protective policies to be taken into account in EU legislative activity, the requirements for individual economic activities are being approximated. Using the example of the MiFID II and IDD directives, the article also aims to answer whether this tendency is appropriate and, if so, to what extent.
